Question
What was Sayyiduna Mu’awiyah (radiyallahu ‘anhu) referring to when he said ‘Ayna ‘Ulamaukum‘? Sahih Muslim, Kitabus Sawm.

The full Hadith is as follows:
Humayd ibn ‘Abdir Rahman narrates that he heard Mu’awiyah ibn Abi Sufyan (radiyallahu ‘anhu) say on the mimbar on the day of ‘Ashura’ in the year he went on hajj, ‘O people of Madinah! Where are your men of knowledge [‘Ulama]? I heard Rasulullah (sallallahu ‘alayhi wa sallam) say, ‘This is the day of ‘Ashura, Allah has not made fasting compulsory, but I am fasting. Whoever wishes can fast and whoever wishes need not fast.'”

Sayyiduna Mu’awiyah (radiyallahu ‘anhu) asked ‘Where are your scholars’, implying that they ought to be informing and rectifying you.
‘Allamah Nawawi (rahimahullah) explains, ‘Sayyiduna Mu’awiyah (radiyallahu ‘anhu) had become aware of some people deeming the fast of ‘Ashura to be wajib, haram or disliked. He therefore clarified the issue, that it it is not wajib or haram, rather it is Sunnah.’

Hafiz Ibn Hajar (rahimahullah) says, ‘The context of the narration seems to indicate that Sayyiduna Mu’awiyah (radiyallahu ‘anhu) felt that the people were not showing this fast due importance. He therefore inquired as to where were the scholars? [They should be encouraging you to fast.]

It is possible these particular people in Madinah were not fully informed of the matter.

(٢٠٠٣) – حدثنا عبد الله بن مسلمة، عن مالك، عن ابن شهاب، عن حميد بن عبد الرحمن، أنه سمع معاوية بن أبي سفيان رضي الله عنهما، يوم عاشوراء عام حج على المنبر يقول: يا أهل المدينة أين علماؤكم؟ سمعت رسول الله صلى الله عليه وسلم، يقول: «هذا يوم عاشوراء ولم يكتب الله عليكم صيامه، وأنا صائم، فمن شاء، فليصم ومن شاء، فليفطر».
صحيح مسلم:
(١١٢٩) – حدثني حرملة بن يحيى، أخبرنا ابن وهب، أخبرني يونس، عن ابن شهاب، أخبرني حميد بن عبد الرحمن، أنه سمع معاوية بن أبي سفيان، خطيبا بالمدينة – يعني في قدمة قدمها – خطبهم يوم عاشوراء، فقال: أين علماؤكم؟ يا أهل المدينة، سمعت رسول الله صلى الله عليه وسلم يقول – لهذا اليوم – «هذا يوم عاشوراء، ولم يكتب الله عليكم صيامه، وأنا صائم، فمن أحب منكم أن يصوم فليصم، ومن أحب أن يفطر فليفطر».
شرح النووي على مسلم:
(٢٦٤٨) – وأما قول معاوية (أين علماؤكم) إلى آخره فظاهره أنه سمع من يوجبه أو يحرمه أو يكرهه فأراد إعلامه وأنه ليس بواجب ولا محرم ولا مكروه وخطب به في ذلك الجمع العظيم ولم ينكر عليه قوله عن معاوية (سمعت رسول الله صلى الله عليه وسلم يقول لهذا اليوم هذا يوم عاشوراء ولم يكتب الله عليكم صيامه وأنا صائم فمن أحب منكم أن يصوم فليصم ومن أحب منكم أن يفطر فليفطر) هذا كله من كلام النبي صلى الله عليه وسلم هكذاجاء مبينا في رواية النسائي.
فتح الباري لابن حجر:
(٢٠٠٣) – قوله: «أين علماؤكم» في سياق هذه القصة إشعار بأن معاوية لم ير لهم اهتماما بصيام عاشوراء فلذلك سأل عن علمائهم أو بلغه عمن يكره صيامه أو يوجبه.
