Question
What is the authenticity of the narration where Rasulullah (sallallahu ‘alayhi wa sallam) advised Sayyiduna ‘Ali (radiyallahu ‘anhu) to always hear both sides of a story before passing judgement?
Answer
Imam Tirmidhi (rahimahullah) has recorded the following narration and has declared it sound (hasan):
Sayyiduna ‘Ali (radiyallahu ‘anhu) says, Nabi (sallallahu ‘alayhi wa sallam) told me:
“When two people come to you for a judgement, do not pass any ruling for the first person until you hear the other person’s case. You will then know how to pass a ruling.”
(Sunan Tirmidhi, Hadith: 1331)
Imam Ahmad (rahimahullah) has also recorded the following version:
Sayyiduna ‘Ali (radiyallahu ‘anhu) says, Nabi (sallallahu ‘alayhi wa sallam) once sent me as a judge and said:
“When two disputing parties come to you, then do not pass a judgement against one party until you hear the other person’s case. [After hearing out both parties] A ruling will then become clear.”

(١٣٣١) – حدثنا هناد قال: حدثنا حسين الجعفي، عن زائدة، عن سماك بن حرب، عن حنش، عن علي قال: قال لي رسول الله صلى الله عليه وسلم: «إذا تقاضى إليك رجلان، فلا تقض للأول حتى تسمع كلام الآخر، فسوف تدري كيف تقضي»، قال علي: «فما زلت قاضيا بعد».
هذا حديث حسن.
مسند أحمد: (١/ ١٤٩)
حدثنا عبد الله، حدثني محرز بن عون بن أبي عون، حدثنا شريك، عن سماك، عن حنش، عن علي، قال: «بعثني رسول الله صلى الله عليه وسلم قاضيا، فقال: إذا جاءك الخصمان فلا تقض على أحدهما حتى تسمع من الآخر، فإنه يبين لك القضاء».
صحيح ابن حبان:
(٥٠٦٥) – أخبرنا محمد بن أحمد بن علي الجوزي بالموصل، حدثنا محمد بن إسماعيل الأحمسي، حدثنا عمرو بن حماد، حدثنا أسباط بن نصر، عن سماك، عن عكرمة، عن ابن عباس، عن علي، قال: بعثني رسول الله صلى الله عليه وسلم برسالة، فقلت: يا رسول الله تبعثني وأنا غلام حديث السن؟، فأسأل عن القضاء ولا أدري ما أجيب، قال: «ما بد من ذلك، أن أذهب بها أنا أو أنت»، قال: فقلت: وإن كان، ولا بد أذهب، أنا، فقال: انطلق، فاقرأها على الناس، فإن الله تعالى، يثبت لسانك، ويهدي قلبك، ثم قال: «إن الناس سيتقاضون، فإذا أتاك الخصمان، فلا تقضي لواحد، حتى تسمع كلام الآخر، فإنه أجدر أن تعلم لمن الحق».
